Living Wage Rates 2009
On June 15, 2000, Toledo City Council passed the Living Wage Law which required that the City and certain employers doing business with the City of Toledo pay their employees working on City contracts at least 110% above the Federal Poverty Level for a family of four (4) with a minimum level of health insurance or 130% above the Federal Poverty Level when health insurance is not made available. These rates are adjusted annually according to the updated Federal Poverty Level in the Federal Register. Based upon the current guidelines, the 2009 living wage rate is $11.67 per hour with a minimum level of health insurance and $13.79 per hour when health insurance is not provided. Prevailing Wage
All contractors must provide a list of subcontractors and sub-subcontractors as they become known and before work is began to the City of Toledo Department of Affirmative Action/Contract Compliance, this can be done by FAX at 419.245.1058. All contractors including all subcontractors are required to submit certified, signed original payrolls to the City of Toledo when working on any city project. Payrolls must be submitted to Ernie Berry , Administrative Anaylst. There are three wage scales that may be a factor in any project.
The Davis-Bacon Act wage scale will apply when United States HUD funds are involved in a project. Those wage rates can be found at: http://www.wagehour.dol.gov. At the time the project begins, and before the bids are taken, the prime contractor and the subcontractor(s) must be familiarize themselves with the Federal wage scale. It frequently differs from the State of Ohio prevailing wage scale. The Federal wage scale has a lock-in provision that generally means that once the scale is determined for a project, it does not change throughout the life of the project. Davis-Bacon applies to the whole project even though only a portion is funded with Federal money.
State of Ohio prevailing wages will apply to a project where government funds are being used, the project is not subject to Davis-Bacon, and the total project amount exceeds the threshold amounts as required by the Ohio at: http://wagehour.com.state.oh.usThe State of Ohio prevailing wage rates change periodically. The contractor and all subcontractors are responsible to ensure that the changes in wages are reflected in the payroll of their employees..
City of Toledo living wage rate may apply if Davis-Bacon or State of Ohio wage rates do not apply. Please note that the living wage rate is tied to the federal poverty index and changes annually.
